Which kinds of staffing firms do you work with?
Firms of 5 to 200 people: temp and contract staffing agencies, direct-hire recruiting firms, retained executive search practices, and RPO providers. The desks differ, but the problem is the same: language work AI can absorb, and candidate data and screening decisions that need an approved tool and a written policy.
Can recruiters put resumes into ChatGPT?
Only into a tool your firm has approved for candidate data, under a written rule about what may go in. Consumer chat tools with default settings can train on what you paste, and a resume is a full identity package. Most firms end up with an approved business-tier tool for candidate work, a consumer tool allowed for marketing and job-ad drafting with no names attached, and a one-page rule every recruiter can quote.
Is it legal to use AI to screen candidates in California?
Yes, with conditions. Since October 1, 2025, California's employment regulations under FEHA treat staffing agencies and AI screening vendors as agents of the employer, require automated-decision data to be kept for four years, and make evidence of anti-bias testing relevant to any discrimination claim. Title VII, the ADA, and the ADEA still apply even though the EEOC withdrew its AI guidance in January 2025, and Mobley v. Workday, a nationwide age-discrimination collective action over AI resume screening, is still moving through federal court in California. We set screening tools up as a drafting and ranking aid with a recruiter making the call, and we write the testing and retention steps into the policy.
Does the CCPA cover our candidate database?
Job-applicant data has been fully covered since January 1, 2023, for any business that meets the CCPA's size thresholds, and the privacy regulator's rules effective January 1, 2026 add a deadline: from January 1, 2027, a covered business using automated decision-making technology for hiring decisions must give candidates advance notice and a way to opt out. Many independent agencies are below the thresholds, so the first step is checking whether you are covered. Either way, the same data map and vendor inventory from the assessment answers the question.
Can AI run our background checks?
It can draft the paperwork and organize results. It cannot skip the steps the law requires: written consent up front under the FCRA and California's ICRAA, and under the Fair Chance Act an individualized assessment, a written preliminary notice, and at least five business days for the candidate to respond before an offer is withdrawn. We build those steps into the workflow so the human review is a checkpoint, not a habit.
What about candidates we place in other states?
Placing out of state adds rules. Illinois has required notice and barred discriminatory AI in hiring since January 1, 2026. New York City has required annual bias audits of automated hiring tools, and notice to candidates, since 2023. Colorado's rewritten AI law takes effect January 1, 2027. Can an executive search firm use AI on confidential searches?
Yes, with isolation. Retained searches carry client confidentiality and often non-disclosure terms, so the work goes into a tool that does not train on your data, with candidate and client names handled under the same rule as PII. Where the volume justifies it, a private deployment on hardware you control keeps the whole search in-house.
Will AI make our recruiters redundant?
Not the good ones. The firms that get the most from AI use it to clear the drafting and research work between conversations: intake notes, candidate summaries, job descriptions, client updates, sourcing research. The recruiter still owns the relationship, the judgment call, and the offer. Our training is built on your live requisitions so the habit survives after we leave.
